This Annual Membership Commitment Agreement (“Agreement”) is a legally binding contract between you (“Member,” “you,” or “your”) and Gowanus Golf Club (“Company,” “we,” “us,” or “our”). By checking the acceptance box at checkout and completing your purchase, you acknowledge that you have read, understand, and agree to be bound by the terms of this Agreement.
1. Commitment Term
You are enrolling in a membership with a minimum commitment of twelve (12) consecutive months, beginning on your membership start date (“Commitment Term”). This is an annual commitment, regardless of billing frequency.
You are financially responsible for all membership dues for the full Commitment Term.
2. Monthly Billing Authorization
Membership dues are billed monthly during the Commitment Term. By providing your payment information and completing checkout, you expressly authorize Gowanus Golf Club to charge your payment method on a recurring monthly basis for all amounts due under this Agreement, including membership dues, renewal charges, outstanding balances, and any applicable early termination fees.
3. Automatic Renewal of Commitment
Unless properly canceled in accordance with Section 4, your membership will automatically renew for an additional twelve (12) month commitment term, billed monthly, at the then-current membership rate.
You acknowledge and agree that no additional notice or additional affirmative consent is required for renewal beyond your acceptance of this Agreement.
4. Cancellation Notice and Method
To avoid renewal into a new 12-month Commitment Term, you must submit notice of cancellation no fewer than five (5) calendar days prior to your renewal date.
All cancellation requests must be submitted in writing by email to:

Cancellations submitted through any other method (including verbal requests, in-person requests, social media, or text messages) are not valid.
Cancellation requests received fewer than five (5) days before the renewal date will not prevent renewal, and the membership will renew for the next Commitment Term.
5. Early Cancellation and Financial Responsibility
If you cancel, terminate, or otherwise end your membership before completion of your current Commitment Term, the following terms apply:
a. Cancellation Within First Three (3) Months
If cancellation occurs within the first three (3) months of your Commitment Term, all amounts paid are non-refundable, and no proration or credits will be issued, except as required by applicable law or as otherwise approved by Company in its sole discretion.
b. Cancellation After Three (3) Months
If cancellation occurs after the first three (3) months but before the end of the Commitment Term, you agree to pay an early termination fee (“Early Termination Fee”) equal to the lesser of:
- Three (3) months of membership dues, or
- The remaining membership dues owed for the balance of the Commitment Term
The Early Termination Fee is due immediately upon cancellation and may be charged to the payment method on file.
You acknowledge and agree that this fee represents a reasonable estimate of damages incurred by Gowanus Golf Club due to early termination and is not a penalty.
6. Non-Payment
Failure to make timely monthly payments may result in suspension or termination of access. Non-payment does not relieve you of your obligations under this Agreement. If your membership is terminated for non-payment prior to the end of the Commitment Term, the Early Termination Fee may still apply.
7. Refunds and Proration
Membership fees are generally non-refundable, and no proration or credits are guaranteed for unused time, partial months, or early cancellation.
Any refunds or prorated adjustments, if granted, are provided solely at the discretion of Gowanus Golf Club on a case-by-case basis and do not create any obligation to provide similar accommodations in the future.
8. Changes to Pricing
If your membership renews, renewal pricing may differ from your initial rate and will be charged at the then-current published rate.
9. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of New York, without regard to conflict of law principles.
10. Acknowledgment and Acceptance
By checking the box below and completing checkout, you expressly acknowledge and agree that:
- This membership includes a 12-month minimum commitment
- Membership is billed monthly
- The commitment automatically renews unless canceled at least five (5) days before renewal
- Early cancellation fees apply, including the three-month minimum responsibility
- Refunds and proration are not guaranteed and are handled at Company’s discretion
- You understand and agree to the email-only cancellation method
- You authorize Gowanus Golf Club to charge your payment method in accordance with this Agreement
