I have read the Moneylines Limited Liability Company dba Gowanus Golf Club Waiver and Release of Liability and understand that it is a release of liability in favor of Gowanus Golf Club, its officers, directors, owners, investors, managers, employees, representatives, agents, independent contractors, volunteers, affiliates, subsidiaries, insurance carriers, suppliers, successors, and assigns (collectively, herein, “Gowanus” or the “Company”) that is binding on myself and my spouse, parents/legal guardians, heirs, executors, administrators, and assigns. 

This Waiver and Release of Liability applies to today and each time I enter the premises and/or participate in activities at Gowanus Golf Club at 124 9th Street, Brooklyn, NY 11215 (the “Facility”).

Assumption of Risk:

I knowingly and freely understand that my use or any of my guests to the Facility, equipment, premises, and/or services will be undertaken at my sole risk and I will be responsible for any liability to my guests.  I understand that I or any of my guests will be engaging in activities at the Facility that may involve the risk of serious personal injury, illness (such as COVID-19), permanent disability, dismemberment and death, and that may also involve the risk of severe economic and property loss and damage.  I understand that these risks may result from the actions, negligence and/or failure to act of myself and my guests and others (including, but not limited to, the Company and other participants), as well as the physical challenges inherent in the use of the Facility and the condition of any real or personal property or equipment used at the Facility. I also understand that there may be risks involved which are not known to me and/or my guests and the Company, and may not be foreseen or reasonably foreseeable by any of the foregoing entities or persons at this time or at the time in which I or my guests may participate.

I, and/or on behalf of my guests, assume all of the foregoing risks, including the risk of any  negligence by other participants and the Company, and the risk of injury caused by the condition of any real or personal property, facilities or equipment used at Gowanus, and accept personal responsibility for any injury (including, but not limited to, personal injury, disability, dismemberment and death), illness, damage, loss, claim, liability or expense (including reasonable attorneys’ and professionals’ fees), of any kind or nature, that I and/or my guests may suffer arising out of or in connection with my and/or my guests use of the Facility.
